Cambodia Title Classifications

HARD TITLE

A hard title represents the most potent property ownership form in the country. Hard titles act as an ownership certificate provided through the National Land Management and Planning Office.

A hard title comes with recognised and certified information pertaining to ownership certified throughout Cambodia at the Ministry of Land Management Urban Planning and Construction.

There is a four per cent tax applicable when the transaction is approved for hard titles.

SOFT TITLE

Soft titles are more commonly used in Cambodia as land titles. The soft title is recognised at a government level and provided by the local district or commune but not registered at a national level; however, it is still validated as possessory status.

Many transactions are conducted using a soft title as it negates ownership fees and transfer taxes.

Today in Cambodia, you will find the majority of new development projects are approved using hard titles as soft titles can be open to third parties contesting the land and can end up in litigation. However, the government has made moves to convert soft-land titles into hard ones, but this is ongoing.

Foreign Ownership

Using a Nominee 

The most inexpensive way of owning actual ground floor bricks and mortar or land is to purchase through a Cambodian citizen. However, we do not encourage this method.

Many companies will still offer this service, but at Lux, we can present you with safer options for ownership. If you were to choose the nominee route after looking at your options, we would advise considerable due diligence of the person(s) you would be using as there is a lack of regulation if anything goes wrong.

Co-owned Buildings

In 2010 there was a significant breakthrough in the Kingdom for the foreign right of ownership when a ‘Strata Title’ became available. However, these only apply to a recently completed apartment or condominium building.

Foreigners can now own units from the first floor fully and upwards but no more than 70% of the number of units in the building.

Condominiums for Investment 

Off-Plan

As far as investment is concerned, this is the best time to buy and offers the most upside potential on your investment. At this stage, you have a more comprehensive range of options to purchase.

Completed Projects

With completed projects, although prices will be higher than off-plan, you have the luxury of being able to see a tangible asset and inspect the completed facilities.

Land and Landed Properties

Although foreigners by law cannot own freehold land outright, Lux has options that assist foreign nationals in gaining interest over land.

LANDHOLDING COMPANIES

One of these options is to incorporate a Land Holding Company (LHC).

In this scenario, the company is incorporated using a Cambodian citizen. However, the company is structured whereby they do not have the same amount of voting rights.

This method is usually reserved for premium land as there are higher costs involved, and the LHC is subject to tax on profits, but it is generally considered the safest way to do it.

Land Ownership Rules in Cambodia
