Lease Agreement Terms – What to Expect

Term of Lease

The lease period generally starts at six months onwards and may or may not offer renewal options. When negotiating, you will find similarities to other countries whereby the more prolonged the tenure, the lower the rental cost.

Rental Payment

There is a range of rentals available from unfurnished, part-furnished to fully-furnished. The majority come with fixtures, fittings, and for newer properties, maintenance fees, but usually, water and electricity are excluded.

Serviced Apartments typically come with cable TV and internet, as do some standard apartments owned by millennials or younger; however, these can sometimes come as additional charges.

Rentals in the Kingdom are payable almost exclusively a month in advance.

Security Deposit

Security deposits depend upon the type of lease (company or personal) and the lease period.

Security deposits are equivalent to one or two months of the agreed monthly rental, paid in full when the Tenancy Agreement is signed and refundable at the end of the tenancy without interest and are subject to the terms and conditions of the agreed lease.

The landlord has the right to deduct expenses or costs from a deposit if any of the Tenancy Agreement terms are breached.

Tenancy agreements are prepared initially in Khmer and translated into English for signing.

Legal Fees

Rarely will a landlord wish to have the Tenancy Agreement prepared by a solicitor whereby the tenant must bear either legal fees or additional costs of the agreement. In most cases, a Tenancy Agreement is typically prepared by the landlord or the agent at no charge to the new tenant.

Tax on Rental

The tax rate is 10% gross of the rental price agreed. The tax is paid to the General Department of Taxation of the Ministry of Economy and Finance. For the tenant, this does not apply to you as these are collected from landlords and proprietors.

Utilities

In some cases, serviced apartments/condominiums charge a fixed rate for utilities such as water and electricity.

For those who do not include utilities, we ensure both tenant and landlord note meter readings at the start of the tenancy.

Many serviced apartments/condominiums charge rates ranging from US$0.25 to US$0.30 per kw. Water can be in the range of US$5-10 per month.

Telephone and Internet

Suppose the property does not come with either telephone or internet. In that case, Cambodia has many telecommunications options, both fixed-line and mobile, that now cover even remote areas.

There are many providers, such as Cellcard, Metfone, SMART, EZECOM and others.

The Handover

Unless the Tennant has further requirements from the landlord, this can be conducted in a week, sometimes quicker.

Land Ownership Rules in Cambodia

Foreigners can buy and invest in property and land in Cambodia.
