In 1992 land was redistributed, and 4 different land titles were issued:

• Hard title
• Soft Title
• Strata Title
• LMAP title

These act as official proof of ownership within the Kingdom.

How Can a Foreigner Own Land in Cambodia?

The Land Law of Cambodia states the only land a foreigner can own is through a strata title. Strata titles, however, are only applicable to co-owned condominiums and residential buildings, not land.

Nevertheless, there is foreign-owned land in Cambodia. As in neighbouring countries, there are exceptions that foreigners can appropriate through marriage, citizenship, long-term lease, using a local nominee structure, or incorporating a land-holding company and even by concession, own land in Cambodia.

How Can a Foreigner Guarantee Protection of Land Ownership?

Naturally, foreigners will feel more at risk and need to be more thorough with attention to security detail than a local; however, it is not as complicated as some think.

When a Khmer nominee is used for land ownership, foreigners agree with a Cambodian citizen(s) an agreement in the form of a long term lease.

Subsequently, a mortgage should then be arranged and registered. The foreigner(s) should also have and hold the original title document.

When dealing with the legal side of this at Lux, we always recommend avoiding misunderstanding that the nominee(s) should have a will and supporting documents prepared in the event of death.

With regards to a landownership company, nominee protection documents must be drawn up. Again, the company must grant a long term lease just like the first example a mortgage should be arranged and registered along with the title. And again, a will and supporting documents are prepared in the event of death.

The difference with Cambodia compared to its neighbours is their current outlook and approach to local and international investors, whereby the country’s evolution is evolving to accommodate international investors.
